These Terms & Conditions apply to all engineering services, machining, engine building, gearbox building, component manufacture, restoration work and the supply of goods undertaken by Barratt Engineering Ltd (“Barratt Engineering”, “we”, “our” or “us”).
By accepting a quotation, instructing us to undertake work, or placing an order, you agree to these Terms & Conditions. Where a quotation, statement of work or written agreement differs from these Terms, the quotation or statement of work shall take precedence for that specific project.
1. Quotations & Scope of Work
All quotations are valid for 30 days unless otherwise stated.
Quotations are based upon the information available at the time they are prepared. Where additional work, replacement parts or machining is identified following dismantling or inspection, we will advise you and seek approval before proceeding wherever reasonably practicable.
Completion dates are estimates only. While we make every effort to complete work within the estimated timescale, delays may occur due to supplier lead times, specialist machining, unforeseen defects, customer-requested specification changes or circumstances beyond our reasonable control.
2. Customer Supplied Parts
We are happy to work with customer supplied parts where agreed.
However, we cannot guarantee the quality, condition, previous history or suitability of components supplied by others.
If, during inspection or machining, we believe a component is unsafe, excessively worn, damaged or unsuitable for its intended use, we reserve the right to recommend its replacement or decline to use it.
Barratt Engineering cannot accept responsibility for the failure of customer supplied components.
3. Engineering Work
All work will be carried out with reasonable care and skill and in accordance with the agreed specification.
Where necessary, equivalent components may be substituted provided they do not materially reduce the performance, reliability or suitability of the finished product.
Any quoted power outputs, torque figures or performance estimates are provided as guidance only unless specifically guaranteed in writing.
4. Payment, Collection & Storage
Unless otherwise agreed in writing, invoices become due upon completion of the work.
Ownership of goods remains with Barratt Engineering until payment has been received in full.
Risk in the goods passes to the customer upon collection or delivery.
Storage charges will apply one calendar month after payment becomes due, unless otherwise agreed in writing.
We reserve the right to charge reasonable storage fees for engines, vehicles, components and other goods remaining in our possession after this period.
5. Test Running & Installation
Unless otherwise agreed in writing, complete engines will normally be test run before collection or dispatch.
A test run is intended to confirm correct oil pressure, basic engine operation and identify any obvious assembly issues. It is not intended to replicate road use, competition use or a dynamometer test.
In some circumstances, including customer-requested collection before completion, outstanding ancillary components or other practical considerations, an engine may leave our workshop before a test run has been completed. Where reasonably practicable, we will advise the customer beforehand.
Unless Barratt Engineering has been specifically contracted to install or calibrate an engine, responsibility for installation, ignition timing, fuelling, ECU calibration, cooling system performance and final commissioning rests with the customer or their appointed installer.
Advice provided regarding installation or tuning is given in good faith but does not replace the responsibility of the installer or tuner to ensure the engine is correctly commissioned.
6. Running-In
Where a running-in procedure is supplied, it should be followed carefully.
Correct running-in is essential to the performance and longevity of a newly built or reconditioned engine.
Failure to follow the recommended running-in procedure may affect engine performance and may be taken into account when investigating any workmanship concerns.
7. Workmanship & Fault Investigation
We take great pride in the quality of our workmanship.
If you believe an engine or component has developed a fault relating to work carried out by Barratt Engineering or a part supplied by us, you should notify us as soon as reasonably practicable.
If a fault is suspected, the engine should not continue to be operated where doing so may reasonably cause further damage.
Please contact us before dismantling, repairing or modifying the engine wherever possible, as this may affect our ability to establish the cause of the issue.
We may ask for the engine or component to be returned to our workshop for inspection before determining the appropriate course of action.
Where we determine, acting reasonably, that a fault has arisen directly as a result of our workmanship or a defective part supplied by Barratt Engineering, we will provide an appropriate remedy. This may include repair, replacement, remanufacture of the affected component or another reasonable remedy appropriate to the circumstances.
Where inspection shows that a fault has resulted from incorrect installation, incorrect tuning, overheating, oil starvation, detonation, over-revving, misuse, accident damage or another cause outside our reasonable control, any inspection or repair work may be chargeable.
8. Competition Engines
Competition and motorsport engines operate under significantly greater loads and stresses than standard road engines.
Unless expressly agreed in writing, Barratt Engineering does not provide an additional commercial warranty for engines supplied primarily for motorsport or competition use.
However, if concerns arise regarding our workmanship or parts supplied by Barratt Engineering, these will be investigated in accordance with the procedure set out in Section 7.
9. Replaced Parts
Unless requested before completion of the work, replaced or unserviceable components may be disposed of after the work has been completed.
Components subject to exchange or manufacturer warranty schemes may need to be retained by Barratt Engineering.
10. Liability & Consumer Rights
Barratt Engineering will always endeavour to provide work of the highest standard.
Nothing in these Terms & Conditions excludes or limits any rights that a consumer has under the Consumer Rights Act 2015 or any other applicable legislation. These Terms are intended to operate alongside those statutory rights, not replace them.
Except where liability cannot lawfully be excluded, Barratt Engineering shall not be responsible for indirect or consequential losses such as loss of earnings, loss of use, competition entry fees, accommodation costs or similar losses.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.
11. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute arising from engineering work undertaken by Barratt Engineering shall be subject to the jurisdiction of the courts of England and Wales.
